Chapter 7 Personal Bankruptcies

If you are overwhelmed by consumer debt, Chapter 7 bankruptcy can give you a fresh start. Sometimes called “liquidation bankruptcy,” Chapter 7 bankruptcy may allow you to eliminate most, if not all, of your unsecured debt, including credit card debt, medical debt, and personal loan debt.

You might not have to liquidate your assets under Chapter 7 bankruptcy. Massachusetts homestead laws allow you to keep up to $500,000 in equity in your primary residence, and, in certain circumstances, federal and state bankruptcy laws let you eliminate your debt while exempting many of your assets.

Although you have the right to represent yourself in bankruptcy court, you will be better served by relying on an experienced attorney who knows the ins and outs of bankruptcy law. Bankruptcy court staff are prohibited from giving legal advice. A bankruptcy attorney will make sure you receive the most benefit allowable by law.
